Prize details and terms and conditions of entry

1. Information on how to enter and the prize forms part of these Terms and Conditions. Participation in this Newcastle Airport and Special Olympics Asia Pacific Games 2013 (“Promotion”) is deemed acceptance of these Terms and Conditions.

2. Promotion commences at 5.00pm Daylight Saving Time (DST) on Wednesday, 13 November 2013 and final entries close at 11.59am DST on Friday, 29 November 2013 (“Promotional Period”). 

3. This Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Participants provide their information to the Promoter and not to Facebook.

4. A public vote on the Newcastle Airport Facebook competition app will determine the winner. Voting commences from the beginning of the competition 5.00pm DST on Wednesday, 13 November 2013 and closes 11.59am DST on Thursday, 28 November 2013 and should be based on the judging criteria: (a) originality, (b) creativity and (c) relevance to contest theme.

5. Entry is only open to Australian residents 13 years of age or older (“Entrants”). Winners under 18 years old must be accompanied by an adult.
a) Eligible Entrants less than 18 years of age ("Underage Entrants") must have parental/guardian approval to enter the Promotion.  The parent or guardian of the Underage Entrant must read and consent to these Terms and Conditions.  Parents and guardians may be required by the Promoter to enter into a further agreement as evidence of consent.  
b) If the winner or any of their guests are under the age of 18, one of the guests must be his/her parent or legal guardian. Minors must be accompanied at all times during the evening (including, but not limited to, dinner at Rustica Newcastle Beach, Chauffeur-driven transport to the Opening Ceremony venue, and when backstage undertaking the VIP meet and greet at the Opening Ceremony event) by the minor's parent or legal guardian. 

6. Employees (and their immediate families) of the Promoter, participating partners, and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister, or first cousin.

7. To enter, Entrants must during the Promotional Period:
a) Submit a comment via the app on Newcastle Airport’s Facebook page.
b) When submitting via the Facebook app, Entrants must ‘Like’ the Newcastle Airport Facebook page, complete and submit a competition entry form registering their details including, but not limited to, name, email, city, post code, phone number, and caption. 
c) The caption submitted must relevant to the supplied image of Human Nature and must not be defamatory, offensive, or inappropriate as deemed by the Promoter.

8. Costs associated with accessing the competition website remain an Entrant’s responsibility and may vary depending on the Internet service provider used.  

9.There is no limit to the number of different captions that can be entered in the Promotion by an Entrant during the Promotional Period. Each caption must differ from the original entry.

10. Entrants are responsible for inputting the correct information. Should an Entrant’s contact details change during the Promotional Period or should the Entrant wish to withdraw their entry from this Promotion, it is the Entrant’s responsibility to contact the Promoter.

11. Illegible, incomprehensible, and incomplete entries will be deemed invalid.

12. The Promoter accepts no responsibility for any late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction or otherwise including those entries not received by the Promoter.  

13. Entries not fully complying with these Terms and Conditions may be deemed invalid at the Promoter’s discretion. If the winning entry is deemed not to comply with these Terms and Conditions, the entry will be discarded and the prize will be re-awarded.

14. If there is a dispute as to the identity of an Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Entrant. 

15. There will be one Winner of this Promotion. The winner will be chosen on the basis of the number of ‘votes’ received for their caption during the Promotion Period. The winner will be notified by phone and/or email on Friday, 29 November 2013. The Promoter’s decision is final and no correspondence will be entered into.

16. Users wishing to vote may only submit one vote per image, per day.

17. If the Promoter is unable to make contact with the winner within 24 hours of their entry being selected and announced, the finalist will forfeit their right to the prize and the prize will be awarded to the next best finalist. The Promoter’s decision is final and no correspondence will be entered into.

18. The winner’s caption may be featured in future Newcastle Airport promotional campaigns. The winner and three of their friends or family members will be supplied with a voucher for dinner at Rustica Newcastle Beach for the value of $100, and be transported in a chauffeur-driven vehicle from the restaurant to the venue of the Opening Ceremony at Hunter Stadium 294 Turton Rd, New Lambton NSW 2305.

19. Should the winner be under the age of 18, one of their three guests must be over the age of 18, see point four (4).

20. Winner will be announced (and the winning entry published) on the Promoter’s website. 

21. This is a game of skill and chance plays no part in determining the outcome. The criteria for judging will be based on, among other things, originality, creative merit, and relevance.

22. The Promoter reserves the right to refuse to allow the winner to take part in any or all aspects of the prize, if the Promoter determines, in their absolute discretion, that the winner is not in the mental or physical condition necessary to be able to safely participate in the prize.  

23. If for any reason the winner does not take the prize (or an element of the prize) within the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.

24. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify, or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.

25. If the prize (or any part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

26. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

27. Entrants consent to the Promoter using the Entrant’s name, likeness, image and/or voice in the event they are the winner (including photograph, film, and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. 

28. Entrants consent to the Promoter using their image in the event the Entrant is the winner (including photograph, film, and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed, and/or supplied by the Promoter.

29. Prize will be awarded to the Entrant named in the entry.

30. By accepting the prize, the winner agrees to participate in and cooperate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed.

31. As a condition of entering this competition, the Entrant warrants to the Promoter that:
a) The entry (the caption) does not infringe the intellectual property rights or moral rights of any third party; and
b) The Entrant has obtained permission from any third party referenced in the caption.

32. As a condition of entering this competition, Entrants hereby assign to the Promoter, all rights, title and interest in and to all copyright in any material created pursuant to the winner’s participation in any aspect of the competition (“Works”). Entrants acknowledge that the Promoter is free to use the Works and to exercise its rights in relation thereto and the Entrant will not be entitled to any fee for such use.  

33. The Promoter reserves the right, at any time, to verify the validity of an Entrant’s identity, age, and place of residence, and to disqualify any Entrant who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

34. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements; disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Conditions of Entry or who has, in the opinion of the Promoter, engaged in conduct in entering the competition which is fraudulent, misleading, deceptive, or generally damaging to the goodwill or reputation of the competition and/or the Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause. Any entrant disqualified under this clause is prohibited from any further participation in the competition.  

35. The Promoter, its associated agencies and companies (and their respective officers, employees, and agents) exclude all liability (including negligence) except for any liability that cannot be excluded by law, for any direct, indirect, or consequential injury, loss and/or damage arising in any way in connection with this competition or any prize/s. This includes, but is not limited to: (i) technical malfunctions, delays or failures, including those resulting from accessing any materials related to this promotion and any incorrect or inaccurate or incomplete information communicated in the course of, or in connection with, this competition as a result of any technical malfunctions, delays or failures; (ii) theft, unauthorised access or third party interference; (iii) lost or damaged entries, prize claims or prizes; and (iv) acceptance and/or use of any prize (including but not limited to any component of a winner’s trip).   

36. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, technical problems, or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to participants or any other person’s computer related to or resulting from participation in or downloading of any materials in this promotion.

37. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.

38. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.

39. Nothing in these Terms and Conditions limits, excludes, or modifies, or purports to limit, exclude, or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act in Australia, or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.

40. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees, and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by the winner or Entrant; or (f) taking of the prize and/or participation in the prize.

41. All entries become the property of the Promoter. The information Entrants provide will be used by the Promoter for the purpose of conducting this promotion (and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities), and otherwise in accordance with the Promoter’s Privacy Policy (available at /privacy-policy). The Promoter may disclose Entrant’s personal information to its contractors and agents to assist in conducting this competition or communicating with Entrants. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research, and profiling purposes, including sending electronic messages or telephoning the Entrant. Entrant should direct any request to access, update, or correct personal information to the Promoter.

42. The prize will be issued in voucher form for the dinner at Rustica Newcastle Beach (to the value of $X00.00), transport between Rustica and Hunter Stadium will be arranged by the Promoter, as will the VIP meet and greet backstage passes for the Opening Ceremony. 

43. The prize will be valid on Sunday 1 December 2013 only. 

44.  Should the cost of the meal at Rustica exceed that covered by the voucher, the winner will be responsible for the additional cost.

46.  The winner will be responsible for transporting themselves and their accompanying guests to Rustica Newcastle Beach and away from Hunter Stadium.
