WINTER BUY AND FLY ("Promotion")
Conditions of Entry

1.

These official rules ("Rules") apply to the "Winter Buy and Fly Competition" ("Promotion") conducted by Newcastle Airport Pty Limited ACN 060 254 542, c/ - Level 1 (east) Administration offices Newcastle Airport Terminal Williamtown Drive Williamtown NSW 2318 ("Promoter") for the Newcastle Airport ("Airport").

2.

Information on how to enter forms part of these Rules. The Promoter may, at any time, amend, add to , or delete any of these Rules by publishing the change on the Promoter's Nominated URL Site.

3.

If you enter the Promotion you are deemed to have accepted these Rules including any changes made to the Rules by the Promoter, even if the entry is before the publication of any changes to these Rules.

4.

The Promotion commences at 4:00am on Monday, 11 July 2016 and ends at 11:59pm on Wednesday, 31 August 2016 ("Promotion Period").

Eligibility

5.

To be eligible to enter the Promotion (and so be an "Entrant") you must:

  1. be an individual who is an Australian resident aged 18 years or older;
  2. make an Eligible Transaction; and
  3. not be ineligible under clause 14.

Eligible Transaction

6.

An "Eligible Transaction" is a purchase at a Participating Departure Lounge Retail Outlet or a Participating Arrivals Hall Retail Outlet:

  1. of any goods or services, but these must not be:
    1. Tobacco Products; or
    2. Gift Cards; or
    3. telephone, internet or mobile telephone calling cards or credit cards, telephone or data sales or contracts for telephone accessories or products which include telephone or data credit; or
    4. payments for registrations (e.g. motor vehicle registration), payments for utilities (e.g. electricity, gas, telephone), premiums --(e.g. insurance and health fund premiums), rates and subscriptions (e.g. ambulance subscriptions) and lay-by payments; and
  2. for the Minimum Spend (see Rule 10); and
  3. made during the Promotion Period.
7.

A "Gift Card" is a card that is exchangeable for goods and services from a Participating Retailer.

8.

A "Tobacco Product" includes:

  1. tobacco (in any form); or
  2. any product (for example a cigar or cigarette):
    1. that contains tobacco as its main or a substantial ingredient; and
    2. that is designed or intended for human consumption or use; and
    3. that is not included in the Australian Register of Therapeutic Goods maintained under the Therapeutic Goods Act 1989 (Cth); or
  3. a cigarette paper, cigarette roller or pipe.
9.

A "Participating Departure Lounge Retail Outlet" means the following participating retailers:

  • Broughton & Bay
  • Epicure Kitchen Café
  • Hunter & King Coffee Co
  • Red Rooster
  • News Travels
 

A "Participating Arrivals Hall Retail Outlet" means the following participating retailer:

  • Cibo Cafe
10.

A Valid Receipt must show an amount of at least:

  1. $15.00 or more at any Participating Departure Lounge Retail Outlet; or
  2. $10.00 or more at any Participating Arrivals Hall Retail Outlet ("Minimum Spend")
11.

An Eligible Transaction must be evidenced by a "Valid Receipt" being an original official store docket from a Participating Retailer that is clearly marked with the date of purchase, the amount of the purchase and the store or business trading name. If you want to claim the Prize if you are successful you must retain your Valid Receipt.

12.

A Valid Receipt must show an amount of at least the Minimum Spend.

13.

For the avoidance of doubt, an individual will be entitled to one Entry unique code for each Valid Receipt ie where a Valid Receipt from a Participating Departure Lounge Retail Outlet evidences an Eligible Transaction totaling more than $15.00, the individual will only be entitled to one Entry unique code.

14.

The Promoter, Participating Retailers and their respective officeholders, employees, agents, contractors, and their Immediate Family Members are not eligible to enter the Promotion.

15.

"Immediate Family Member" means any spouse, child, de-facto or any other family member residing at the same premises as that person.

16.

An individual may enter the Promotion as many times as they wish, provided these Rules are complied with.

Entry

17.

An Entrant will be entitled to complete and lodge one official online Entry Form for each Eligible Transaction.

18.

An Entry Form is to be completed and lodged online at the Promoter's nominated URL site ("Nominated URL Site") which is available online via the internet or using the electronic modules located at the display of the Prize in the Airport terminal, during the Promotion Period.

19.

To be valid, an Entrant's online Entry Form ("Valid Entry Form") must:

  1. be completed and lodged online at the Nominated URL Site;
  2. include the Entrant's full name, telephone number, email address, and suburb of residence;
  3. have the "opt-in" box ticked whereby the Entrant consents to its personal information being collected and to being contacted by Newcastle Airport in relation to services, promotions, and special offers provided by Newcastle Airport and its retailers; and
  4. include a valid unique code as provided to the Entrant by the relevant Participating Retailer at the time of making an Eligible Transaction.
20.

On lodgement of a Valid Entry Form in accordance with these Rules, the Valid Entry Form will be entered into an electronic database ("Competition Database") and an Entrant will be eligible for the prize draw ("Prize Draw") (see Rule 28).

21.

Upon a duplication of the unique code on a Valid Entry Form, all entries with this code will be void.

Prize

22.

The prize available for the Promotion comprises of one (1) $5,000 voucher valued at $5,000 (accordingly the total prize pool is valued at $5,000) (referred to as "Prize" separately or jointly as the context requires).

23.

The $5,000 voucher standard terms and conditions ("Helloworld Terms") apply to the Prize along with the condition in clause 26.

24.

The prize Terms can be viewed online at: https://helloworld.com.au

25.

The Prizes will contain an expiry date which will be nominated on each voucher. The Winners must use the Prizes prior to the expiry date or they will otherwise lose the Prize.

26.

If the winner uses the voucher for any flights, the flights must start and conclude at Newcastle Airport.

Drawing and Collection of Prizes

27.

The Prize will be drawn electronically from the Competition Database at the Promoters management office on Monday 5 September 2016 at 9:00am

28.

The Entrant whose name appears on the first Valid Entry Form randomly selected in the Prize Draws from the entries received during the Promotion Period ("Winner") will win the Prize (ie one voucher per winner).

29.

If a Valid Entry has two or more individuals names recorded as the Entrant, the Winner will be the individual whose name appears first on the Valid Entry drawn.

30.

The Winner needs not attend the Prize Draw to claim the Prize. The Winner will be notified after the Prize Draw by either telephone or email.

31.

To be able to collect a Prize the Winner must provide proof of the Winner's Valid Receipt, identity and age.

32.

The Winner must collect the Prize from the Promoter's management office, on the date and time nominated by the Promoter at the discretion of the Promoter.

33.

UNCLAIMED PRIZE: The Promoter reserves the right to select a new Prize winner in the event of an Entrant failing to comply with these terms and conditions or forfeiting or not claiming the Prize by Monday 3 October 2016 for the Prize draw. If the Prize remains unclaimed by that date, a second Prize award will be held at 12.00pm (AEDT) on Monday 10 October 2016 at the same location as the original Prize award. Disposal of any unclaimed Prize may be made subject to any written directions given by any government authority and pursuant to any relevant legislation. An unclaimed Prize winner will be contacted by phone or email immediately.

34.

The Winner's name will be published on the Newcastle Airport website within seven days of the Prize Draw.

General

35.

The Prize provider is Hunter Travel Group trading as Helloworld ABN 39 183 096 957 located at 144 Hannel Street Wickham NSW 2293

36.

The Promoter is collecting your personal information through you entering into the Prize Draw. This information is collected to allow you to claim the Prize (if applicable) and also for the Promoter's marketing and promotional purposes. If you do not provide your personal information you will not be able to claim the Prize if you are the Winner. Your personal information may be disclosed to third parties such as Helloworld or the Promoter's IT providers who manage the Promoter's database. The personal information of Entrants will be held and used in accordance with Newcastle Airport's privacy policy which is available at www.newcastleairport.com.au. This privacy policy contains further information about how we manage personal information, other entities we may disclose this information to and your rights to access personal information the Promoter holds about you.

37.

In accepting the Prize, the Winner hands over worldwide image release rights to The Promoter and its nominated partners to use the Winner's image an unlimited number of times in any form of media for promotional, marketing, advertising, commercial, and other related purposes.

38.

If the travel voucher is used for flights or accommodation please note flights and accommodation are subject to availability. The Winner will assume all responsibility and costs for passports, visas, travel insurance, licensing and/or stamp duty. The Promoter accepts no responsibility or liability for any portion of the Prize not being redeemed by the expiry date.

39.

The Prize is not transferrable or exchangeable and cannot be taken as cash. If for any reason the Prize is not available, the Promoter reserves the right to substitute another item for it, in their sole discretion of equal or higher value.

40.

In the event of war, terrorism, state of emergency, or disaster, the Promoter reserves the right (subject to all relevant State and Commonwealth laws), to cancel, terminate, modify or suspend the Promotion.

41.

The Promoter's decision in respect of all aspects of the Promotion is final and binding on all participating individuals and no correspondence will be entered into.

42.

The Promoter will not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered (including but not limited to that arising from any person's negligence) in connection with the Promotion and/or any aspect of the Prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

43.

The Promoter makes no representation or warranty about the fitness for purpose or merchantable quality of the Prize.

44.

Nothing in these terms and conditions limits, excludes or modifies or attempts to limit, exclude or modify any non-excludable statutory guarantees in the Competition and Consumer Act 2010 (Cth) or other non-excludable statutory guarantees in NSW.

45.

All participating individuals are responsible for any taxation liability (including any GST) or other government charges or reporting requirements arising from their participation in the Promotion or receipt of the Prize (if any). If participation in the Promotion or receipt of the Prize involves a taxable supply being made, then the participating individual is responsible for paying any amount charged by the entity making the supply in respect of its GST liability on the supply. The Promoter does not offer any advice or accept any responsibility with respect to these matters.

46.

If for any reason this competition is not capable of running as planned including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affects the administration security, fairness, integrity or proper conduct of this competition as determined by the Promoter in its absolute discretion then it will be suspended.

47.

Unless indicated on the Entry Form (by ticking the relevant opt-in box), all participating individuals consent to their personal information being entered onto a database, which may be made available to the Promoter for marketing purposes relating to the promotion of the Airport and retailers located in the Airport.
